Pre-acquisition Survey

It is essential for any purchaser of commercial property to be fully informed of its condition, whether the property is for occupation or bought as an investment. In either case, unexpected defects can have very serious consequences. For leasehold property there are often onerous obligations imposed in respect of repairs and alterations, and it may be possible to negotiate changes in the lease terms to limit liabilities if serious defects are found. We undertake pre-acquisition surveys on all types of commercial property, whether of modern or historic construction.

Dilapidations

Leases impose a range of obligations on both landlord and tenant. At the expiry of a lease, a landlord can make a dilapidations claim against a tenant. We can prepare a Schedule of Dilapidations which details the breaches of the tenant’s lease obligations, usually relating to reinstatement, repair and redecoration. Although less common, dilapidations claims can also be made during a lease. Substantial liabilities and costs can arise and you should contact us for advice if you are nearing the end of a lease or if you have been served with a notice or schedule. We can be instructed to act on behalf of either landlord or tenant.

Schedule of Condition

A Schedule of Condition is a photographic record of the condition of a property at a point in time. It can be a useful way of limiting your liability under a new lease. Our schedules are clear and comprehensive, thus avoiding any ambiguity if it is referred to a later time.

Planned Maintenance

For larger assets it is important to understand the overall condition of a building to plan for maintenance and repairs, and avoid sudden unexpected costs.  We can prepare a Condition Report which documents all major repairs and expected timescales and costs to help you budget accordingly. We have long-standing relationships with a number of local schools, estates, retirement/care homes and block management companies.
